1. Acceptance of These Terms

By accessing or using the LactSafe web application (the “Service”), you ("you," "your," or "User") acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Service.

2. Who We Are

LactSafe is an educational tool created by Lauren and Earn to provide concise safety summaries for medications during pregnancy and breastfeeding, based primarily on the NIH LactMed® and MotherToBaby databases.

3. Eligibility

The Service is intended for users aged 18 and older. By using the Service, you represent that you are at least 18 years old or that you have the consent of a parent or legal guardian.

4. Informational Purposes Only & No Medical Advice

All content provided by LactSafe is for general informational purposes only. It does not constitute medical or legal advice, diagnosis, or treatment and should not be relied upon as a substitute for consultation with qualified healthcare professionals. Always seek the advice of your physician, pharmacist, or other qualified provider with any questions regarding a medical condition or medication.

5. User Responsibilities & Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not: (a) attempt to reverse‑engineer, decompile, or hack the Service; (b) use the Service to distribute malicious software or spam; (c) collect data or content from the Service by automated means without express permission; or (d) violate any applicable local, state, national, or international law while using the Service.

6. Intellectual Property & License to Use

All text, graphics, logos, and other content on the Service are owned by or licensed to LactSafe and are protected by copyright, trademark, and other intellectual‑property laws. LactSafe grants you a limited, non‑exclusive, non‑transferable license to access and use the Service for personal, non‑commercial purposes, subject to these Terms.

7. Data Sources & Accuracy

We strive to keep information current and accurate, but we do not warrant that the content is complete, up to date, or free of errors. Medication recommendations may evolve as new research emerges. You agree that it is your responsibility to verify any information obtained from the Service with qualified healthcare providers.

8. Privacy & Browser Storage

Your privacy is important to us. Please review our Browser Storage Policy and Privacy Policy to understand how we collect, use, and safeguard information, including data stored in your browser’s localStorage.

9. Third‑Party Links & External Content

The Service may contain links to third‑party websites or resources. LactSafe is not responsible for the content, products, or services on or available from those sites or resources and does not endorse them. Accessing any third‑party resources is at your own risk.

10. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON‑INFRINGEMENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LACTSAFE, ITS CREATORS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF LACTSAFE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LACTSAFE’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS UNDER THESE TERMS SHALL NOT EXCEED USD 100.

12. Indemnification

You agree to defend, indemnify, and hold harmless LactSafe and its creators from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

13. Modifications to Service & Terms

We may modify or discontinue any part of the Service at any time without notice. We may also revise these Terms from time to time. Continued use of the Service after such changes constitutes your acceptance of the new Terms. The date of the latest update will always be posted at the top of this page.

14. Termination or Suspension

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, USA, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Richmond, Virginia, for resolution of any dispute arising out of or relating to the Service or these Terms.

16. Dispute Resolution

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute related to the Service by contacting us at [email protected]. We will attempt to resolve the dispute informally within 30 days.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, along with our Privacy Policy, Browser Storage Policy, and Medical & Legal Disclaimer, constitute the entire agreement between you and LactSafe regarding your use of the Service.
